Learn more about the cost of the FOSFA Arbitration & Appeals service
Our arbitration and appeals service provides impartial dispute resolutions for members and non-members who use our standard contracts for trading.
The fees for using the service are listed below.
Our arbitration and appeal fees
Arbitration deposits – £10,000
Appointment of arbitrator by FOSFA
- Members – £125
(includes members of AIC/NFU in disputes on contract numbers 9A and 26A only, members of NEODA in disputes on contract number 90 only, and members of ANEC in disputes under any ANEC contract)
- Non-members – £250
Fees – First Tier
FOSFA fees calculated as follows:
- Basic charge of £825 per award
- Discount of £250 where both parties are FOSFA members
- Additional charge of £825 for each non-member
- The above totals are subject to a discount where small tonnages (mt) are involved:
- Up to 25mt = 75%
- 26mt-50mt = 65%
- 51mt-100mt = 50%
- 101mt-150mt = 40%
- 151mt-250mt = 25%
- Additional net charge of £10 for each page of awards in excess of four pages
- Production of final award £350
- Notwithstanding the net result of the above, a minimum charge of £300 will apply
Arbitrator Fees
This cost is fixed by the arbitrators at their discretion and charged in addition to the FOSFA fees. VAT may be applied to some fees, if the arbitrator is registered.
Appeal Deposits – £15,000
Appeal Fees
FOSFA fees – £2,250
- There will be a 50% discount when both parties are Members (including Members of AIC/NFU in disputes on Contract Nos 9A and 26A only, Members of NEODA in disputes on Contract No 90 only, and Members of ANEC in disputes under any ANEC contract).
Board Fees
- These are fixed by the Board at their discretion and charged in addition to the FOSFA fees. VAT may be applied to some fees, if the arbitrator is registered.
Production of Final Award – £350
Notarised Standard Certificate of an Award (plus any additional Notary Fees/courier charges) – £150
Arbitration deposit – £2,750

(includes the appointment of a sole arbitrator)
- There will be an additional charge of £250 for each non-member
Sole arbitrator fee
- Fixed by the arbitrator at their discretion up to a maximum of £1,000 and charged in addition to FOSFA fees
This service is restricted to Brokers and includes the appointment of a Sole Arbitrator.

Online published awards service (limited access) – free to members
A searchable database of nearly 500 awards, which mostly consists of first tier arbitration awards. Where the awards have been challenged, the FOSFA Appeal Award has been incorporated into the file. This ensures both formal decision processes in respect of the dispute are presented. Up to 30 new awards are added to the database annually.
